By accessing or using the website, applications, and services of Onetaste Food Cafe & Services (“Onetaste,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”) and all terms incorporated herein by reference. If you do not agree to all of these Terms, do not use our Services.
2. Onetaste Food cafe &Services
Onetaste operates a dual business model:
- Cloud Kitchen Operations: We prepare and sell our own branded food products directly to customers (“Onetaste Meals”).
- Delivery & Logistics Platform: We act as an intermediary, providing a platform and delivery services for independent, third-party cloud kitchen owners (“Partner Kitchens”) to sell their food products to you.
3. Delivery Policy
3.1 Delivery Area and Time
Delivery is available only in the designated areas specified on the platform. We will make every effort to deliver your order within the estimated time frame, but these times are estimates and delays may occur due to traffic, weather, or unforeseen circumstances. Onetaste is not liable for any loss or damage arising from delayed delivery.
3.2 Customer Responsibility
You must ensure that the delivery address and contact information provided are accurate. If delivery cannot be completed due to your failure to provide access, be available, or provide correct details, the order will be charged in full, and no refund will be issued.
4. Third-Party Partner Kitchens
4.1 Partner Kitchen Responsibility
When you order from a Partner Kitchen, you are purchasing food directly from that third-party entity. Onetaste is solely responsible for providing the logistics and delivery service.
4.2 Quality and Allergy Disclaimer
- Onetaste is not responsible for the food quality, preparation standards, ingredients, or accuracy of allergy information provided by Partner Kitchens.
- While Onetaste takes reasonable steps to vet its Partner Kitchens, all food safety, quality, and allergy concerns regarding Partner Kitchen meals must be directed to the respective Partner Kitchen.
- For Onetaste Meals, we take all reasonable precautions but cannot guarantee a complete absence of allergens. If you have a food allergy, you must contact us directly before placing an order.
5. Website Use and User Conduct
You are granted a limited, non-exclusive, non-transferable license to access and use the Onetaste website for placing orders and accessing our services. You agree not to use the site for any unlawful or prohibited purpose.
6. Intellectual Property
All content on the Onetaste website, including text, graphics, logos, images, and software, is the property of Onetaste Food Cafe & Services or its content suppliers and is protected by copyright and intellectual property laws.
7. Limitation of Liability
To the fullest extent permitted by law, Onetaste Food Cafe & Services, including its directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from:
- Your use of the Services or inability to use the Services.
- Any conduct or content of any third party on the Services, including any Partner Kitchen.
- Any unauthorized access, use, or alteration of your transmissions or content.
8.Prohibited and Criminal Activities
Onetaste Food Cafe & Services is a platform designed solely to connect cloud kitchen owners with their customers. Through this platform, only legitimate activities such as the exchange of information, buying, and selling of food products are permitted.
Any of the following activities below are strictly prohibited and may result in immediate suspension of the account, legal action, and reporting to authorities:
- Selling, distributing, or promoting food products containing illegal or banned substances, unauthorized colors, or prohibited additives under Indian law.
- Selling or promoting any food or product that hurts religious sentiments or violates cultural sensitivities.
- Selling or facilitating the sale of drugs, narcotics, or controlled substances, either directly or indirectly, through the Onetaste platform.
Any violation of this clause may lead to criminal investigation and prosecution under applicable Indian laws.
9.Governing Law
These Terms shall be governed by the laws of the State of Karnataka, India without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the courts located in Bengaluru.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by updating the “Last Updated” date at the top of these Terms. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
